Commercial Agreement
If you are visiting the John Temple Gallery web site for personal reasons you
will not be affected in any way by accepting these terms necessary for viewing
the images. If you are visiting this site in order to find images which you
intend to purchase then you agree to these terms of use by continuing to
navigate around the site. When you make a purchase you must agree to the terms
and conditions as set out here. If you do not agree to these terms, then you
will not be able to complete your purchase. Please enjoy your viewing
experience.
These Terms and Conditions of use constitute an agreement between You the
purchaser and Archer Temple Pty Ltd trading as John Temple Gallery, Landscape
Photography of 103 Meander Valley Road, Westbury, Tasmania, Australia.
Please read the Agreement below and indicate your acceptance of these terms and
conditions by clicking on the "I have read the Terms and Conditions" button on
the shopping cart checkout page.
Use of Images: You agree not to use any of the Images in a manner
which would contravene any law of any country in which copyright of the image
exists. You agree that the copyright owner of any image that you purchase from
this site is John Temple.
You have the right to dispose of, gift or sell the original image as purchased
from John Temple Gallery. You do not have the write to copy the image in any
form or in any manner including but not limited to digital photography or
scanning the image without the express written permission of the copyright
owner, John Temple.
Warranty: John Temple Gallery warrants the print and or framed
print to be free of defects and manufacturing workmanship. All claims must be
made within 30 days of delivery of the product or within 60 days of our shipping
whichever is the shorter period.. The sole and exclusive remedy for a breach of
this warranty is the replacement of the product, a refund or a credit against
next purchase as agreed between You and John Temple at the time of warranty
claim. Other than as stated in this Agreement, You acknowledge that the product
is supplied "as is" and that John Temple Gallery has not made, and that no
person acting for or on behalf of John Temple has made any other representation
for additional service or suitability for any particular purpose unless such
representation is in writing and signed by John Temple.
To the extent permitted by law you agree that John Temple Gallery, Archer Temple
Pty Ltd or employees and contractors of Archer Temple Pty Ltd offer no liability
whatsoever and that You indemnify John Temple Gallery and hold it harmless
against any liability, damage, cost or expense arising out of or in connection
with any failure of the product.
No Liability: To the maximum extent permitted by law, John Temple
Gallery will not be liable to You or any 3rd party in any way for loss or
damages of any kind, including (without limitation) any consequential, special,
indirect or direct damages with the use of this product.
Returns Policy. By accepting this agreement you agree to abide by
our returns policy as set out on the returns and shipping
page.
International Customs Charges and Destination Country Taxes
You agree that you understand that international freight charges ARE included in
your order total, but that import duties and other taxes, which may be levied in
the country of destination, cannot be assessed by John Temple Gallery and are
therefore NOT included. You agree to pay those duties and taxes to the Freight
Company or customs officer or customs agent upon request.
In the event that You fail to pay all the relevant import duties and local taxes
at the time of import, You authorise John Temple Gallery to charge to your
credit card with any costs, including charges which may be incurred by the
shipping company in relation to Your delivery such as but not limited to storage
or engaging a customs agent.
Entire Agreement: This Agreement contains the entire agreement between the
parties relating to your use of the print and or framed print. and supersedes
any previous agreement including any oral agreement.
WEBSITE DISCLAIMER
John Temple Gallery gives no warranty of any kind, implied or expressed, no
claims, promises or guarantees about the accuracy, completeness, or adequacy of
the contents of this Website.
John Temple Gallery takes all reasonable steps and care to ensure the protection
of personal information obtained by us, however we make guarantees and cannot be
held liable. If you do not agree to this policy you should not use the Internet
send confidential or sensitive information.
COPYRIGHT NOTICE
Copyright exists in the contents of this Website, including without limitation
all trade marks, text, graphics and information, and is owned by John Temple
Gallery. Copying or reproduction of the whole or any part of this Website in any
form, including electronic media, is expressly prohibited except that you may
print or download to a local hard disk extracts for your own personal use,
provided that you acknowledge John Temple Gallery as the source of the material.
Your continued use of the website will be your acknowledgment of your agreement
to the policy.
This Agreement will be interpreted and governed by or in accordance with the
laws of Australia.
